The main part of the thesis focuses on the definition of terms related to crimes and especially their regulation and the current situation in the Czech Republic. Within the Czech Republic, the Prison Service and the context are also described. The work also includes the issue of social work in the prison environment.
Resocialization of juvenile offenders in the practice of probation and mediation service

The aim of the bachelor thesis is to map the procedures of the Probation and Mediation Service of the Czech Republic both in criminal proceedings conducted with juvenile offenders and in their re-socialization. The work will be divided into theoretical and practical part. In the theoretical part, the author defines the basic legal concepts in the field of youth justice, the diversity of concepts of retributive and restorative justice, the issue of punishment and imposition of educational measures for juvenile offenders and external evaluation of their activities from the wiew of Probation and Mediation Service of the Czech Republic and Authority for social and legal protection of children and juveniles. The practical part will be investigated by the method of qualitative analysis of structured interviews with probation officers and with juvenile offenders, who undergo accredited re-socialization programs, their attitudes and the process of their re-socialization. In particular, attention will be paid to the question of how these programs are perceived, evaluated by minors themselves, and how they have influenced their lives. The sample will consist of clients and staff of the Probation and Mediation Service of the Czech Republic in Jindřichův Hradec, Třebíč, Tábor and České Budějovice.
Alternatives to unconditional sentence of imprisonment

The subject of this master's thesis is a description of the current legislation and application practice of selected punishments that represent the main alternatives to the imposition of unconditional prison sentences. These punishments are house arrest, community service, financial penalty, suspended sentence of imprisonment and suspended sentence of imprisonment with supervision. Since each of the abovementioned punishments could be the subject of a separate master thesis, this thesis does not aim to describe the subject matter in detail, but rather to present the individual institutes in their mutual context, to compare their characteristic features, purpose, conditions, specifics of their execution, as well as their use in judicial practice. The thesis consists of eight chapters, three of which are of a general nature, four deal with individual penalties and the last one is devoted to de lege ferenda proposals. The first chapter defines the very concept of criminal punishment and its purpose. A substantial part of the chapter is devoted to the historical development of penology theories regarding the purpose of the criminal punishment, with special focus on the transition from a retributive and punitive view of punishment to the concept of restorative justice. Activity of the Probation and Mediation Service in the Czech Republic Abstract and keywords The presented thesis deals with the position of the probation and mediation service (PMS) within the criminal law policy of the Czech Republic, its procedures in the field of probation, mediation and other actions it performs within the framework of the criminal process with adult offenders. This work covers juvenile offenders minimally. The aim is to broadly cover the entire activity and role of the probation and mediation service during criminal proceedings. For that reason, the work is divided into several basic sections. The first section deals with the question of punishment and different approaches to this issue, especially in terms of retributive versus restorative justice. A closer examination of the current use of these two approaches shows that we should not even set them against each other, but rather side by side. Furthermore, the work focuses on PMS as an institution. It deals with the way in which it was created, what are its main goals, the purpose for which it was established, but also how it is organized. The content bachelor thesis is methodical process of the Probation and Mediation Service in the preparation and execution of a sentence of home detention and community service. Thesis is eventually focused on the activities of the Centre in the Czech Lipa, using statistical data for a specified period.
Expert evidence in criminal proceedings

This thesis addresses the use of expert evidence in criminal trial proceedings. The author's primary aim is to present a thorough analysis of this highly specific form of evidence as contained in the Criminal Procedure Code, Act No. 141/1961 Coll., to identify its insufficiencies, and to suggest some potential legislative modifications. The author is aware that the role of an expert in criminal proceedings is also determined in part by the Act on Experts and Interpreters, Act No. 36/1967 Coll., but he deals with this organizational norm only marginally, as his main goal is to analyze the possibilities of using expert evaluations within the framework of criminal procedure. In this thesis, the author describes the historical development of this type of evidence, discusses the concept of the role of the expert in legal theory, and above all, presents his views regarding the law currently in effect, describing the use of expert evidence from its initial stages of appointment of an expert to the preparation and presentation of the expert opinion and the evaluation thereof. The author also takes account of some currently topical issues such as the confrontation of experts and the use of computer software in the expert's work. Probation and its Elements in the Czech Legal System

At present, number of developed countries seeking alternatives to punish the perpetrators. As an alternative to unconditional sentence of imprisonment is called probation and this institute is a central issue this rigorous work. Regularization of probation can be found in Act No. 257/2000, Coll. the Probation and Mediation Service, as amended. The performance of probation is authorized Probation and Mediation Service, respectively their individual centers. This rigorous work is divided into two parts, namely the theoretical and practical. The theoretical part includes the interpretation of terms associated with probation and its performance, a description of the Probation and Mediation Service, an analysis of existing legislation with regard to the institutions in which it is applied, and description probation activities in Great Britain. In the practical part of the study was used knowledge and information that I gained during visits the Probation and Mediation Service in Rokycany.
Supervision of a probation officer over criminal irresponsible children

Diploma thesis "Supervision of a probation officer over criminal irresponsible children" deals with juvenile delinquency, juvenile justice law adaptation for criminal responsible children younger 15 years of age and concerns with the ways by which society can react to the juvenile delinquency according to valid law adaptation. In its theoretical part this thesis focuses on definition of the keywords such are 'child', 'age limits of criminal responsibility', 'delinquency'. Thesis includes also description of juvenile delinquency as such where the law adaptation related to this issue is taken into consideration as well as the discipline precautions which can be ordered by court of law as a reaction to the unlawful behaviour. The goal of the practical part is to map the obstacles which discourage effective usage of discipline precautions supervision of a probation Office and suggest possible solving. The analytical part of the thesis was realised by two techniques, namely, questioning technique and document analysis.
